WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

In consideration of being permitted to enter, use, observe, participate in, or receive instruction, training, coaching, services, or access to the facilities, equipment, programs, events, and activities of 916 BOXING GYM ("Gym"), I agree as follows:

1. ACKNOWLEDGMENT OF RISKS

I understand and acknowledge that boxing, fitness training, strength and conditioning, sparring, contact drills, bag work, pad work, weight training, cardiovascular exercise, and related activities are inherently dangerous and involve known and unknown risks that may result in serious bodily injury, concussion, traumatic brain injury, paralysis, permanent disability, illness, emotional distress, property damage, or death.

I understand that risks may arise from, including but not limited to:

• Physical exertion and overexertion

• Contact with other participants

• Punches, strikes, kicks, falls, collisions, and impacts

• Sparring and combat-sport-related activities

• Equipment malfunction or misuse

• Slippery surfaces or facility conditions

• Negligence of participants, instructors, employees, or other persons

• Failure to follow instructions or safety rules

• Known and unknown hazards that cannot be completely eliminated

I voluntarily choose to participate despite these risks.

2. ASSUMPTION OF RISK

I knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with my participation in any activity conducted, sponsored, supervised, or permitted by the Gym.

I accept full responsibility for any injury, illness, loss, damage, disability, or death that may occur as a result of my participation or presence at the Gym.

3. RELEASE OF LIABILITY

To the fullest extent permitted by California law, I hereby release, waive, discharge, and covenant not to sue 916 BOXING GYM and its owners, members, managers, officers, directors, employees, contractors, coaches, trainers, volunteers, agents, affiliates, representatives, successors, assigns, landlords, and property owners (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to my participation in Gym activities, use of facilities, use of equipment, attendance at events, or presence on Gym premises. This release includes claims arising from the ordinary negligence of the Released Parties but does not apply to claims arising from gross negligence, reckless conduct, or intentional misconduct to the extent such claims cannot be waived under California law.

4. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, liabilities, damages, costs, attorney fees, or expenses arising out of or related to:

• My participation in Gym activities;

• My actions or omissions;

• My violation of Gym rules or policies; or

• Any claim brought by or on behalf of me, my spouse, heirs, estate, family members, or representatives.

5. HEALTH REPRESENTATION

I certify that I am physically capable of participating in boxing and fitness activities and have no medical condition that would prevent safe participation. I understand that the Gym is not providing medical advice and recommends that participants consult a physician before engaging in strenuous physical activity. I agree to immediately inform Gym staff of any injury, illness, medical condition, or physical limitation that may affect my ability to participate safely.

6. MEDICAL TREATMENT AUTHORIZATION

In the event of an emergency, I authorize the Gym to obtain emergency medical treatment on my behalf if deemed necessary. I understand and agree that the Released Parties are not responsible for any medical expenses incurred as a result of my participation and that I am solely responsible for all medical costs, ambulance fees, hospital charges, physician fees, rehabilitation expenses, and related costs.

7. FACILITY AND EQUIPMENT USE

I agree to use all facilities and equipment safely and only as instructed.

I understand that boxing gloves, hand wraps, punching bags, speed bags, rings, weights, resistance equipment, exercise machines, flooring, mats, locker rooms, and other equipment may present risks of injury.

I agree to inspect equipment before use and immediately report unsafe conditions.

8. COMPLIANCE WITH RULES

I agree to comply with all Gym rules, safety requirements, coach instructions, and staff directives. I understand that failure to follow safety instructions may increase my risk of injury and may result in suspension or termination of my membership without refund.

9. COMMUNICABLE DISEASES

I understand that participation in activities involving close physical contact may expose me to communicable diseases, viruses, bacteria, and other illnesses. I voluntarily assume all risks associated with exposure to communicable diseases and release the Released Parties from liability relating to such exposure, except where prohibited by law.

10. PHOTO AND VIDEO RELEASE

I grant the Gym permission to photograph, record, or otherwise capture my image, likeness, voice, or appearance while participating in activities at the Gym. I authorize the Gym to use such photographs, videos, recordings, or images for promotional, advertising, marketing, educational, and business purposes without compensation or further approval.

11. ARBITRATION AND GOVERNING LAW

Any dispute arising out of or relating to this Agreement or my participation in Gym activities shall be governed by the laws of the State of California. To the fullest extent permitted by law, disputes shall be resolved through binding arbitration in Sacramento County, California, in accordance with the rules of the American Arbitration Association. Each party shall bear its own attorney fees and costs unless otherwise awarded by the arbitrator or required by law.

12. SEVERABILITY

If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

13. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties regarding liability and assumption of risk and supersedes any prior oral or written understandings relating to such matters.

14. ACKNOWLEDGMENT

I acknowledge that:

• I have carefully read this Agreement.

• I fully understand its contents.

• I understand that I am giving up substantial legal rights.

• I am signing voluntarily and without coercion.

• I intend for this Agreement to be binding upon myself, my spouse, heirs, beneficiaries, estate, executors, administrators, successors, assigns, and legal representatives.
